The union health ministry has asserted that the possession of e-cigarettes in any form, volume, or manner is in direct violation of the Prohibition of Electronic Cigarettes Act( PECA), 2019.
In a explanation issued to the Ministry of Civil Aviation( MCA) last month, the health ministry called for strict enforcement of the ban one-cigarettes, news agency PTI reported.
Although PECA doesn’t explicitly mention the prohibition of individual e-cigarette use, the law is designed to exhaustively enjoin all aspects of these products, the ministry said.
This includes product, manufacturing, import, import, transport, trade, distribution, storehouse, and announcement of e-cigarettes. “ thus, possession of e-cigarette within the country in any volume isn’t possible without breaching the vittles of PECA, 2019, ” said Dr Pulkesh Kumar, deputy clerk in the Ministry of Health.
The ban under PECA 2019 extends to include all types of electronic nicotine delivery systems, heat not burn products, e-hookah, and analogous bias.
The legislation was legislated with the primary ideal of securing public health and icing protection from implicit detriment, the health ministry said. It must be noted that e-cigarettes continue to be readily accessible through colorful channels, including tobacco merchandisers, general stores, and online retailers despite being banned.

Before in July, the health ministry transferred notices to 15 websites for dealing e-cigarettes. The websites were asked to incontinently cease all announcements and deals of e-cigarette.
It was also reported that six further websites were under the lens of the ministry, while it was also covering advertising and trade of e-cigarettes on social media platforms.
PECA came into effect in 2019. The health ministry has raised enterprises over vacuity of e-cigarettes in the history as well.
In February this time, it wrote to all countries and Union homes pressing enterprises over the vacuity of e-cigarettes through original merchandisers.
Later in May, it also issued a notice directing directors, manufacturers, importers, exporters, distributors, advertisers, transporters, social media websites, and online shopping platforms to refrain from producing, earning, or dealing e-cigarettes directly or laterally.
